Article 42 – Condominium owners cannot make any changes on their own in the common areas of the main real estate; all innovations and additions that will make the common areas more proper or more comfortable and easy to use or increase the benefit to be obtained from these places are made upon the decision of the majority of the condominium owners in number and land share.

(Additional paragraph: 1/7/2005-5378/19 art.) In case it is deemed necessary for the life of the disabled, the project modification shall be discussed in a meeting of the condominium owners to be held within three months at the latest and shall be decided by a majority of the number and land share. If the meeting cannot be held within this period or the request for modification is not accepted by the majority; upon the request of the relevant condominium owner, construction, repair and installation shall be carried out according to the approved project change or sketch to be received from the relevant authorities based on the commission report stating that the building security is not endangered. The relevant authorities shall finalize the approved project change or sketch requests within six months at the latest. The establishment of the commission, its working method and the procedures and principles regarding the process after the disabled person’s use shall be determined by a regulation to be prepared jointly by the Ministry of Public Works and Settlement and the Presidency of the Administration for the Disabled. The expenses of these works shall be paid by those who benefit from the innovations according to the rate of benefit.

PART ONE

Purpose, Scope, Definitions and General Principles

Purpose

ARTICLE 1.- The purpose of this Law is to prevent disability, to solve the problems of the disabled regarding their health, education, rehabilitation, employment, care and social security. and to ensure their participation in society by taking measures to ensure their development in every respect and to remove obstacles in their way and to make the necessary arrangements for the coordination of these services.

Scope

ARTICLE 2.- This Law covers the disabled, their families, institutions and organizations providing services to the disabled and other relevant parties.

Definitions

ARTICLE 3.- In the implementation of this Law;

  1. a) Disabled: Congenital or who have difficulties in adapting to social life and meeting their daily needs due to losing their physical, mental, spiritual, sensory and social abilities to varying degrees for any reason and who need protection, care, rehabilitation, counseling and support services. the person who hears it,
  2. b) Disability criteria: Criteria prepared on the basis of international basic criteria and revised when necessary,

  8. h) Rehabilitation: A workplace where the disability occurs due to any reason, whether congenital or acquired. to eliminate or reduce the effects of disability to the lowest possible level, by enabling the disabled person to regain physical, mental, psychological, spiritual, social, vocational and economic capabilities at the highest level that they can achieve; The whole of preventive, medical, occupational, educational, recreational and psycho-social services provided for the purpose of being self-sufficient and socially sufficient in their home, work and social life, and for the disabled person to integrate with society, and to take all measures against discrimination,

ARTICLE 4.- The following principles shall be complied with in the performance of the services within the scope of this Law:

  1. a) The State shall develop social policies against all kinds of exploitation of the disabled and the disabled based on the inviolability of human honor and dignity. Classification,   Care, Rehabilitation, Employment, Education,

Job and Occupation Analysis

Classification

ARTICLE 5.-  ... The determination of the disability criterion and the principles of its application are determined by the regulation to be issued jointly by the Ministry of Finance, the Ministry of Health, the Ministry of Labor and Social Security, the Ministry of National Education and the Presidency of the Administration for Disabled Persons.

Care

ARTICLE 6.-     It is essential that people continue their lives in health, peace and security in the environment they are in, that they are cared for and rehabilitated in a way that they can manage themselves and become productive in society, that those who need them are taken under temporary or permanent care or that home care services are provided to them.

Licensing

Service provision

ARTICLE 8.- In the provision of care services, the biological, physical, psychological and social needs of the person are also taken into consideration. Types of care

ARTICLE 9.- Care services can be provided with home care or institutional care models.  First of all, it is essential to provide the service without separating the person from their social and physical environment.

Rehabilitation

ARTICLE 10.- Rehabilitation services are provided to meet the individual and social needs of the disabled on the basis of participation in social life and equality. The active and effective participation of the disabled person and their family is essential in every stage of the rehabilitation decision, including its planning, implementation and termination.

Needs in every area of ​​rehabilitation Training programs are developed for the training of the personnel needed and necessary measures are taken for the employment of these personnel.

Early diagnosis and preventive services

ARTICLE 11.- Monitoring the physical, auditory, sensory, social, spiritual and mental developments of newborns, early childhood and every period of childhood, ensuring early diagnosis of genetically transmitted diseases that may cause disability, preventing disability, reducing the severity of existing disability to the lowest possible level Studies on reducing it to a lower level and stopping its progression are planned and carried out by the Ministry of Health.

Job and occupation analysis

ARTICLE 12.-Job and occupation analyses that take into account the disabilities are carried out by the Ministry of National Education and the Ministry of Labor and Social Security under the coordination of the Presidency of the Administration for Disabled Persons. In light of these analyses, vocational rehabilitation and training programs appropriate to the conditions of the disabled are developed by the aforementioned institutions.
