Article 1 – Parties

Article 2 – Subject

This agreement governs the sale and delivery of the product ordered electronically (e-commerce) by the BUYER from the SELLER’s website https://www.liftart.com.tr, including all rights and obligations of both parties under Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts.

The Buyer acknowledges having received clear, understandable, and complete information online regarding the seller’s name, title, contact details, the essential characteristics of the product, total price including taxes, payment method, delivery terms, associated costs, the right of withdrawal, how to exercise it, and the official authorities for complaints or objections, and confirms the order electronically.

Pre-order information on https://www.liftart.com.tr and the invoice issued upon the Buyer’s order are integral parts of this agreement.

Article 3 – Product / Payment / Delivery Information

The type, quantity, brand/model, total price, payment method, recipient, delivery address, invoice details, and shipping fees of the electronically purchased product(s) are as follows. The invoiced party must be the same as the contracting party. All information must be accurate; the Buyer assumes full responsibility for errors or omissions.

The SELLER reserves the right to suspend orders if provided information does not match reality. If the SELLER cannot contact the BUYER within fifteen (15) days via provided contact details, the order may be canceled to prevent damages to both parties.

Article 4 – Agreement Date and Force Majeure

The agreement date is the date the Buyer placed the order: ../../….

Force majeure includes unforeseen circumstances beyond the parties’ control (natural disasters, war, terrorism, strikes, legislation changes, customs delays, etc.) that prevent full or timely fulfillment of obligations. The affected party must notify the other immediately in writing (including email).

If the force majeure continues for thirty (30) days, either party may unilaterally terminate the agreement without liability.

Article 5 – Seller’s Rights and Obligations

5.1 The SELLER undertakes to fully fulfill obligations under Law No. 4077 and related regulations, except in cases of force majeure.

5.2 Individuals under 18 cannot purchase from https://www.liftart.com.tr. The SELLER relies on the age declared by the Buyer.

5.3 The SELLER is not responsible for typographical or system errors in pricing or product information. Price changes due to tax law changes will apply accordingly.

5.4 Payments may be made via credit card (Visa, MasterCard, etc.) or bank transfer. Orders unpaid within one week are canceled. Orders are processed when payment is confirmed. Payment methods without prior coordination (cash on delivery, postal orders, etc.) are not accepted.

Article 6 – Buyer’s Rights and Obligations

6.1 The Buyer undertakes to fulfill obligations except in cases of force majeure.

6.2 By placing an order, the Buyer accepts this agreement and commits to the specified payment method.

6.3 The Buyer confirms receipt of all pre-sale information online and acknowledges the right of withdrawal.

6.4 The Buyer confirms having read and understood the order/payment/use procedures on the website.

6.5 Products must not be damaged or used for returns, and original invoices and delivery notes must be included.

6.6 Specially manufactured products may be canceled within 3 days with a 30% fee or 3–6 days with a 70% fee. After this, remaining balance is refunded.

6.7 Custom-made products cannot be returned unless defective. SELLER is responsible for repairing defects.

Article 7 – Order / Payment Procedure

Orders are confirmed via email before shipment. Delays or issues will be communicated using the Buyer’s provided contact methods.

Payment must match invoicing details. Credit card payments follow bank authorization; cash refunds are not provided.

Article 8 – Shipping / Delivery Procedure

Orders are shipped via contracted courier after order confirmation or production completion (for custom products). Delivery is generally within 30 days (up to 180 days for custom products). Delays due to external factors are not the SELLER’s liability.

Damaged packages must be refused and documented with the courier.

Article 9 – Returns and Right of Withdrawal

E-Commerce Returns and Exchanges:

  • Standard products may be returned within 14 days.
  • Custom-made products are non-returnable.
  • Returned products must be unused and undamaged.
  • Return procedures require original packaging, certificates, and invoices.

Exceptions: Certain goods such as perishable items, customized products, or items affecting health/hygiene cannot be returned.

Refunds are processed to the original payment method; credit card refunds are subject to bank processing times.

Article 10 – Warranty

Warranty is not insurance. Properly used and maintained products have a 2-year warranty for production defects for consumers under Law No. 4077. Warranty obligations start upon product delivery.

Repair, replacement, or refund rights are in accordance with Turkish Consumer Protection Law.

Article 11 – Privacy

Buyer information is kept confidential and not shared with third parties, except where legally required. Credit card information is securely transmitted to banks and not stored. Emails and contact information may be used for standard service notifications and promotions with Buyer consent.

Article 12 – Governing Law and Dispute Resolution

Disputes are subject to Istanbul Consumer Courts or Consumer Arbitration Committees as per Law No. 4077. By placing an order, the Buyer accepts all terms of this agreement.

LiftArt Membership Agreement

1. Parties
a) LiftArt Quality of Life and Elevator Systems Ltd. Co., Bahçeşehir 1. Kısım Mah. Vali Recep Yazıcıoğlu Cad. Nilüfer Çayı Sok. Villa 5 No:10 Başakşehir, 34488 Istanbul, Turkey (“LiftArt”).
b) Website user registering as a member (“Member”).

2. Subject
This agreement defines the terms of membership use on www.liftart.com.tr.

3. Rights and Obligations of Parties
3.1 Member guarantees that personal information is accurate and will compensate LiftArt for any damages arising from false information.
3.2 Member must not share their password. Unauthorized use liabilities are the member’s responsibility.
3.3 Member agrees to comply with all laws and regulations while using the website.
3.4 Member will not misuse the website, disturb public order, infringe intellectual property, or engage in illegal activity.
3.5 Opinions expressed by members are their own and not LiftArt’s responsibility.
3.6 LiftArt is not responsible for unauthorized access or data loss due to software vulnerabilities.
3.7 Member agrees not to access or misuse others’ data.
3.8 Violation of any clause makes the member legally responsible.
3.9 LiftArt may delete membership unilaterally if necessary.
3.10 Website design and software are LiftArt property and protected by intellectual property laws.
3.11–3.18 LiftArt may collect technical data for site improvement, personalization, and marketing. Members consent to data collection and marketing communications unless opted out.
3.19 LiftArt may send notifications via email/SMS, which members agree to receive.

4. Termination
Membership continues until canceled by member or terminated by LiftArt for violations.

5. Dispute Resolution
Istanbul Courts and Enforcement Offices have jurisdiction.

6. Effectiveness
Membership registration confirms reading and acceptance of all agreement terms.
